PERANAN KERAPATAN ADAT NAGARI (KAN) DALAM PENGALIHAN TANAH ULAYAT UNTUK PEMBANGUNAN FASILITAS UMUM DAN FASILITAS SOSIAL (FASUM DAN FASOS) DI PEDESAAN

Abstract: Land issue is a problem that always attracts attention, because of land issues related to various aspects of life and livelihoods. Utilization of land for public facility and social amenities. In Big Indonesian Dictionary Online, a social facility is a facility provided by the government or the private sector to the public, for example, schools, clinics and places of worship. While the definition of a public facility is a facility provided to the public interest, such as roads and public lighting equipment. Public facility and social facilities require legal rights to the land, whether it was the legality of the ownership status or the legality of the use and management of land. If the legality is nothing that will create tension which is very spacious as conflicts ownership status in the absence of a certificate as proof of land ownership. In the transfer process of communal land for public facilities and social facilities consists of five stages, namely 1) process of deliberation/socialization, 2) process of handing over communal land occupied, 3) process of granting the permission of the regional administration, 4) the process of making a cooperation agreement 5) process of development of facility for public and social amenities. While the role of NAC in the process of communal land starting from the stage of planning, implementation, monitoring and evaluation, utilization and maintenance. But the fact that occur in Nagari Saok Laweh, KAN only take part in its implementation stage only. It is not in accordance with KAN.
